Frequently asked questions
How long must records be retained?
The OSH Act sets no general retention period. Confirmed periods exist for specific cases: asbestos — register and individual files for at least 40 years after exposure; pension insurance master records — 30 or 40 years. Otherwise the archival framework of the Archival Materials Act applies.
Can we use a template downloaded from the internet?
You can, but it usually does not hold up. The act must reflect your actual processes, equipment and workplaces. Inspectors compare whether the instructions match what is actually done on site.
Who is competent for OSH secondary legislation after 2025?
Under the amendment published in Official Gazette of RNM no. 74/25, adoption of OSH secondary legislation passed to the Minister of Economy and Labour, replacing the Minister of Labour and Social Policy.
